Welcome to CloudToVPS. These Terms of Use (“Terms”) govern your access to and use of our website, services, and server management offerings. By using our services, you agree to these Terms. If you do not agree, please do not use our services.

1. Services Provided

CloudToVPS provides:

• VPS or bare metal server provisioning and setup
• Application deployment via Git integration
• Database installation and configuration
• Backup configuration
• Security hardening and firewall setup
• Ongoing monitoring and ad-hoc support (optional)

You retain full ownership of the infrastructure and services we configure on your behalf. We act only as a setup and maintenance provider.

2. Customer Responsibilities

You agree to:

• Provide accurate information necessary for server setup and access
• Ensure your own compliance with your VPS provider’s terms of service
• Maintain the confidentiality of your SSH private keys and credentials
• Use the infrastructure in compliance with applicable laws

You are solely responsible for the content and applications hosted on your servers. CloudToVPS does not monitor or audit your hosted data unless requested under a specific support engagement.

3. Access and Credentials

We access your servers only with the SSH public keys or credentials you provide. We never store or request your private SSH keys. You can revoke our access at any time by removing or modifying our SSH key access.

4. Payment Terms

• Initial Setup Fee: A one-time $99 USD per server setup fee is required before provisioning work begins.
• Monitoring Plan: $49 USD/month per server, billed monthly. You may cancel at any time.
• Ad-Hoc Support: $69 USD per issue, payable before work begins.

All fees are non-refundable once services have been delivered.

5. Backups and Data

While CloudToVPS configures backups where requested, ultimate responsibility for data integrity and restoration lies with the customer. We test backups periodically for monitoring clients but cannot guarantee recovery success if unauthorized changes have been made.

6. Limitation of Liability

To the fullest extent permitted by law:

• CloudToVPS is not liable for any indirect, incidental, or consequential damages.
• Our total liability for any claim arising from your use of the service is limited to the amount you paid us in the past three months.

We are not responsible for outages, data loss, or damages caused by:

• Actions or outages by your VPS provider
• Insecure or malicious application code you deploy
• Failure to follow our provided recommendations

7. Termination

You may terminate your use of our services at any time. We reserve the right to refuse or terminate service if:

• You violate these terms
• Your usage presents a security, legal, or operational risk

Upon termination, our access to your servers will cease, and we will delete all stored configuration data within 14 days.

8. Intellectual Property

All automation scripts, tools, and methods used to provision your servers remain the intellectual property of CloudToVPS unless explicitly transferred or licensed in writing.

9. Changes to These Terms

We may update these Terms of Use from time to time. Continued use of the service after changes means you accept the updated Terms.
